These Terms of Service (“Terms”) govern your access to and use of CertifiedBoater.com and related services, including our boating safety course and learning tools (collectively, the “Site” and “Services”).
The Site and Services are operated by Social Closure LLC, doing business as Certified Boater (“Certified Boater,” “we,” “us,” or “our”).
By accessing or using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site or Services.
1) Eligibility and Use of the Site
You must be at least 13 years old to use the Site.
If you are under the age of majority where you live, you may use the Site only with the consent and involvement of a parent or legal guardian.
You agree to use the Site and Services only for lawful purposes and in accordance with these Terms.
2) Accounts and Registration
Some features of the Services require creating an account.
You agree to provide accurate, current, and complete information when creating an account and to keep your information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately at info@certifiedboater.com if you believe your account has been compromised.
3) Course Access and License
When you purchase or enroll in a course, Certified Boater grants you a limited, non-exclusive, non-transferable, revocable license to access the course content for your personal, non-commercial use only.
You may not:
- Copy, reproduce, distribute, sell, license, or share course content
- Record, scrape, or download course materials except where explicitly permitted
- Use the content for training others or for commercial purposes
All course content remains the property of Certified Boater or its licensors.
Course Access; No Expiration Your access to the course does not expire. You may take as long as you need to complete the course. We may update, improve, or modify course content and the Site over time. We do not guarantee that any specific feature, lesson format, or user interface will remain available indefinitely.
If we discontinue the course or materially change how it is delivered, we will take reasonable steps to provide a path for existing users to complete the course.
4) Payments, Pricing, and Refunds
Payments are processed through third-party payment processors such as Stripe.
Prices, fees, and available payment options are displayed at the time of purchase and may change at any time.
Except where required by law or explicitly stated at checkout, course fees are non-refundable, including after course access has begun or a certificate has been issued.
However, we may issue refunds or credits in limited situations, such as duplicate charges, confirmed payment errors, or verified technical issues that prevent us from providing access to the Services. Any refund decision is made at our discretion unless otherwise required by law.
You are responsible for any applicable taxes.
5) Course Completion, Certification, and State Acceptance
Certified Boater provides boating safety education and reports course completion information to applicable state agencies or authorized partners as required.
Final acceptance of a course, certificate, or proof of completion is determined solely by the applicable state or jurisdiction.
We do not guarantee that completion of the course will result in acceptance, licensing, or certification in every jurisdiction. State requirements may change over time and are outside our control.
6) Intellectual Property
All content on the Site, including text, graphics, logos, videos, course materials, and software, is owned by or licensed to Certified Boater and is protected by intellectual property laws.
Nothing in these Terms grants you ownership of any intellectual property.
7) Prohibited Conduct
You agree not to:
- Violate any law or regulation
- Interfere with the operation or security of the Site
- Attempt to gain unauthorized access to accounts or systems
- Use automated tools to access or scrape the Site
- Misrepresent your identity or eligibility
- Share or resell access to the Services
We may suspend or terminate access for violations of these Terms.
8) Disclaimers
The Site and Services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchant-ability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted access, error-free operation, or specific outcomes. Maintenance, downtime, or service interruptions may occur.
9) Limitation of Liability
To the maximum extent permitted by law, Certified Boater and its owners, officers, employees, and partners will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or Services.
Our total liability for any claim will not exceed the amount you paid to Certified Boater for the applicable Service.
10) Indemnification
You agree to indemnify and hold harmless Certified Boater from claims, damages, losses, liabilities, and expenses arising from your use of the Site or violation of these Terms.
11) Termination
We may suspend or terminate your access to the Site or Services at any time for violation of these Terms or for lawful operational reasons.
Sections that by their nature should survive termination will survive.
12) Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
